01 The agreement

By using ohiovalleyag.com (the "Site") you agree to these Terms of Use ("Terms") and to our Privacy Policy. If you do not agree, please do not use the Site.

"OVA," "we," and "us" mean Ohio Valley Ag, a subsidiary of Equipment Technologies, Inc. ("ET"), a company headquartered in Mooresville, Indiana. "You" means the person reading the screen.

02 Acceptable use

You may use the Site to learn about the equipment we sell, request a quote, find a store, look up parts, and read news. In return, you agree not to:

• Use the Site for anything illegal, deceptive, or harmful.
• Scrape, mirror, or republish substantial portions of the Site without our written permission.
• Probe for vulnerabilities, run penetration tests, or interfere with normal Site operation.
• Submit forms with a false identity, send automated submissions, or try to flood our stores' inboxes.
• Reverse-engineer or attempt to access portions of the Site or our systems that are not publicly exposed.

03 Submissions

If you submit a quote request or any other form on the Site, you confirm the information is truthful and that you have the authority to provide it. You grant OVA a worldwide, non-exclusive, royalty-free license to use that information to respond to your request, route it to the right store, and improve our products and services.

If you send us an idea, photo, video, or testimonial, whether by email, social media tag, or upload, you grant OVA and ET permission to use it in our marketing in exchange for the satisfaction of seeing your machine on the website. We will credit you when we know who you are.

04 Quotes and pricing

A quote requested through the Site is an invitation to begin a conversation with our team. It is not a binding offer to sell at a stated price. Final pricing, financing, lead time, trade-in valuation, and contract terms are set in writing when you buy.

Any prices or payment estimates shown on the Site or in our used equipment listings are illustrative. They can change without notice and are subject to availability, options, freight, taxes, fees, and your local market.

05 Specifications and product info

We work hard to keep specs accurate. Even so, products evolve, options change, and the printed page is always slightly behind the assembly line.

• Specifications, weights, dimensions, capacities, horsepower figures, and option availability are subject to change without notice.
• Photos may show a machine with optional equipment that is not standard, or a configuration that is not sold in your market.
• Color reproduction varies by display.
• Always confirm the current spec, configuration, and option availability with your OVA store before purchasing.

Operator safety

Nothing on this Site replaces the operator's manual that ships with your machine. Read it. Operate equipment only after proper training, with all guards in place, and in accordance with all applicable laws, label rates, and local regulations.

06 Trademarks and copyright

Apache, the Apache wordmark, the ET arrow, and related logos are trademarks of Equipment Technologies, Inc. Ohio Valley Ag and the OVA logo belong to OVA. All other trademarks shown on the Site, including those of the brands we sell, belong to their respective owners and are used here for identification only.

All content on the Site, including text, images, video, layouts, and code, is copyright 2026 Ohio Valley Ag or Equipment Technologies, Inc. unless otherwise noted. You may share links and short excerpts with attribution. Everything else requires written permission.

07 Third-party links

Some links on the Site point to third-party websites, such as TractorHouse, My Dealer, FlipHTML5, etsprayers.com, YouTube, social media profiles, and the brands we sell. We do not control those sites and we are not responsible for their content, terms, or practices. When you leave ohiovalleyag.com, you are on someone else's terms.

08 Equipment warranty

Your machine comes with the manufacturer's limited warranty as described in the warranty document delivered with it. That document, not this Site, is the controlling source for what is covered, for how long, and under what conditions. Ask your OVA store for a copy if you have misplaced yours.

The information on this Site is for general guidance and may be summarized, simplified, or out of date.

09 Site disclaimers

The Site is provided "as is" and "as available." To the fullest extent permitted by law, OVA disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Site will be uninterrupted, secure, or error-free.

Use of the Site is at your own risk. OVA is not responsible for typos, incorrect images, broken links, downtime, or your reliance on any information found here instead of confirming with our team.

10 Limitation of liability

To the fullest extent permitted by law, OVA, ET, and their officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from or related to your use of the Site, even if we have been advised that such damages are possible.

If we are found liable for anything despite the above, our total liability for any claim arising from or related to the Site will not exceed one hundred U.S. dollars (US $100), or the amount you actually paid us through the Site in the twelve months before the claim, whichever is greater.

Some states do not allow the exclusion or limitation of certain damages, so the limits above may not apply to you in full. In those states our liability is limited to the smallest amount the law allows.

11 Indemnification

You agree to defend, indemnify, and hold harmless OVA, ET, and their officers, employees, and suppliers from any claim, loss, or expense (including reasonable attorneys' fees) arising out of your misuse of the Site, your breach of these Terms, or your violation of any law or third-party right.

12 Governing law and disputes

These Terms are governed by the laws of the State of Indiana, USA, without regard to its conflict-of-laws rules. Any dispute arising from or related to these Terms or the Site will be brought exclusively in the state or federal courts located in Marion County, Indiana, and you consent to the personal jurisdiction of those courts.

Disputes about a specific machine, such as its purchase, warranty, or service, are governed by the contract you signed with OVA and the warranty document that came with your machine, not by these Site Terms.

13 Changes to these terms

We may update these Terms from time to time. The effective date at the top reflects the current version. If we make material changes, we will flag them on the home page for at least 30 days. Your continued use of the Site after that date means you accept the updated Terms.
